Terms of Service

Welcome to Bird Bam ("Bam," "we," "us"), a mahjong companion app operated by Tribe Industries Inc., a Utah corporation. These Terms of Service ("Terms") are an agreement between you and us covering the Bam iOS app and the brdbam.com website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle your information.

If you don't agree, please don't use Bam — though we'd be sorry to see you go.

1. Who can use Bam

You must be at least 13 years old and able to form a binding agreement to use the Service. If you're under 18, you may use Bam only with the consent of a parent or guardian.

2. Your account

Keep your login credentials to yourself, give us accurate information, and let us know at support@brdbam.com if you suspect someone else has accessed your account. You're responsible for activity that happens under your account.

3. What Bam is — and isn't

Bam is a scorekeeping and social companion for American mah jongg: log your sessions, track your hands and stats, and share wins with the friends you follow.

Bam is not a gambling service. The Service does not take wagers, hold or transfer money between players, or pay out winnings of any kind. Scores and points in Bam have no cash value. If your group chooses to play for stakes at your own table, that is entirely between you and your fellow players, and you are responsible for complying with the laws that apply to you.

Bam is independent. Tribe Industries Inc. and Bird Bam are not affiliated with, sponsored by, or endorsed by the National Mah Jongg League, Inc. ("NMJL") or any other mahjong organization. NMJL and any other third-party names and marks belong to their respective owners. Card-related reference material in Bam is provided solely for your personal scorekeeping convenience.

Your scores are yours to enter. Bam records what you and your group log. We don't verify gameplay and aren't responsible for scoring disputes — house rules are the law of your table.

4. Bam Pro subscriptions

Some features — currently including hosting or joining a group — require Bam Pro, an auto-renewing subscription.

  • Plans. Bam Pro is offered as a monthly or an annual subscription. The annual plan may include a free trial. The exact price and term are shown in the app before you confirm your purchase.
  • Billing. Payment is charged to your Apple ID through the App Store when you confirm the purchase, or at the end of any free trial unless you cancel at least 24 hours before the trial ends.
  • Auto-renewal. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Renewal is charged within 24 hours before the period ends, at the then-current price.
  • Managing and canceling. Manage or cancel any time in your App Store account settings (Settings ▸ your name ▸ Subscriptions on your device). Deleting the app does not cancel your subscription. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
  • Trials. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Refunds. Purchases are billed by Apple, so refund requests go through Apple at reportaproblem.apple.com.
  • Changes. We may change Pro pricing or which features require Pro. Price changes for an existing subscription follow App Store rules, which require your consent or advance notice before they apply.

5. Your content

You own the content you add to Bam — photos, scores, profile details, and everything else you create ("Your Content"). So that Bam can work, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute Your Content within the Service — for example, showing your winning hand to your followers or your session photos to your group. This license ends when you delete the content or your account, except that (a) content you contributed to a group's shared sessions remains part of that group's record with your identity removed, and (b) content other members have re-shared within the Service may persist.

You're responsible for Your Content. Only post photos of other people with their permission, and only post content you have the right to share.

6. House rules (acceptable use)

Bam is built for friendly tables. You agree not to:

  • harass, threaten, or abuse other members, or use Bam to stalk or intimidate anyone;
  • impersonate any person or misrepresent your affiliation with anyone;
  • post content that is unlawful, infringing, hateful, sexually explicit, or that violates another person's privacy;
  • access or attempt to access another member's account or data without permission, probe or scrape the Service, harvest member information (including through contact-matching), or interfere with the Service's operation;
  • reverse engineer, decompile, or copy the app except where the law allows it despite this clause;
  • abuse invites, trials, subscriptions, or promotions; or
  • use the Service to run any gambling operation, take wagers, or settle gambling debts.

We may remove content, suspend, or terminate accounts that violate these Terms, and we may do so without notice when reasonably necessary to protect the Service or its members.

7. Other members

You'll find blocking tools in the app — blocking someone hides your activity from each other. We may moderate content and accounts, but we don't pre-screen content and aren't responsible for what members post. If something's wrong, report it to support@brdbam.com.

8. Our property

The Service — including the Bird Bam name, logo, app, designs, and everything in it other than Your Content — belongs to us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as permitted by these Terms and the App Store terms. No other rights are granted.

9. Feedback

We love hearing ideas. If you send us suggestions or feedback, we can use them without restriction or compensation to you.

10. Copyright complaints

If you believe content on the Service infringes your copyright, email support@brdbam.com with the details (the work, the location of the allegedly infringing material, your contact information, and a statement of good-faith belief). We'll respond to valid notices, and may remove content and terminate repeat infringers' accounts.

11. Termination

You can stop using Bam and delete your account at any time in Settings ▸ Delete account. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (including 5, 8, 9, and 12–15) do survive.

12. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, error-free, or that scores, stats, or reference material will be accurate — Bam records what its members enter.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or relating to the Service. Our total liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim arose, or (b) US $50.

Some jurisdictions don't allow certain warranty disclaimers or liability limits, so parts of sections 12 and 13 may not apply to you.

14. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules. Before filing a claim, please contact us at support@brdbam.com — most issues can be sorted out quickly and informally. Any dispute that can't be will be resolved in the state or federal courts located in Salt Lake County, Utah, and you and we consent to their jurisdiction.

15. App Store terms

Because you get Bam through Apple's App Store:

  • These Terms are between you and Tribe Industries Inc., not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing claims relating to it (including product liability, regulatory compliance, or IP claims).
  • If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • Your use of the app must also comply with the App Store Terms of Service.

16. Changes to these Terms

We may update these Terms from time to time. We'll post the new version here and update the effective date; for material changes we'll also let you know in the app. Continuing to use Bam after changes take effect means you accept them.
